PRO-LAD

PRO-LAD falls within the generic structural class in Anlage II Z 11 of the Neue-Psychoaktive-Substanzen-Verordnung (NPSV), rather than being listed individually. The class has applied since 23 March 2023 and appears in the current Anlage II. Under § 4(1) of the Neue-Psychoaktive-Substanzen-Gesetz (NPSG), producing, importing, exporting, transferring, or providing a covered substance is punishable by up to two years' imprisonment when done to obtain an advantage and with the intent that another person use it for a psychoactive effect; if the offence causes death or serious bodily injury to a larger number of people, § 4(2) provides one to ten years' imprisonment. Simple possession is not listed as an offence under § 4, but § 5 permits confiscation unless lawful use and safeguards against psychoactive human use are established.

PRO-LAD is covered in Germany by the generic structural definition for Δ9,10-ergolene derivatives in Anlage 1 Nr. 5.2 of the Neue-psychoaktive-Stoffe-Gesetz (NpSG), rather than being listed individually. This structural group has been included since 18 July 2019 and remains in the current consolidated NpSG. Section 3(1) prohibits trade, placing on the market, manufacture, import, export, transit, acquisition, possession, and administration to another person, subject to the recognized commercial, industrial, scientific, and governmental-use exceptions in § 3(2). Under § 4(1), trade, placing on the market, and administration to another person, as well as manufacture or import for the purpose of placing the substance on the market, are punishable by imprisonment for up to three years or a fine; acquisition and possession are prohibited but are not independently penalized by that provision.

Since 1 June 2021, PRO-LAD has been covered by the generic structural definition for lysergamides in I saraksts under Likums “Par Krimināllikuma spēkā stāšanās un piemērošanas kārtību”, 2. pielikums, II nodaļa, 11. punkta 21. apakšpunkts, rather than being individually named. Its N,N-diethyl amide and propyl substitution at the hydrogenated quinoline nitrogen fall within that definition. Section 5 of Narkotisko un psihotropo vielu un zāļu, kā arī prekursoru likumīgās aprites likums prohibits production, manufacture, import, export, distribution, advertising, transport, possession, supply, acquisition, use, and transit through Latvia, while section 7 allows persons to obtain authorization from the State Agency of Medicines for circulation needed for medical or veterinary scientific research, determination of physical and chemical properties, or training. For the I-list lysergamide structural class, quantities up to 0.001 g are classified as small and quantities from 0.002 g as large.

PRO-LAD has been listed by name as item 166 in Annex 6, Verzeichnis e, of the Betäubungsmittelverzeichnisverordnung (BetmVV-EDI) since 1 December 2015. Verzeichnis e materials and products are subject to the control measures applicable to Verzeichnis a narcotics. Cultivation, manufacture, import, export, storage, use, or placing on the market requires authorization from the Federal Department of Home Affairs. Unauthorized conduct is punishable by imprisonment for up to three years or a monetary penalty; control also extends, subject to any stated exemption, to the listed substance's salts, esters, ethers, carbamates, stereoisomers, corresponding derivatives of those stereoisomers, and preparations containing them.

PRO-LAD is listed by its exact name as a Class A drug in Schedule 2 Part I of the Misuse of Drugs Act 1971. Its Class A control took effect throughout the United Kingdom on 7 January 2015. The Act prohibits possession, possession with intent to supply, production, supply or offering to supply, import, and export, subject to applicable regulations, licences, defences, and statutory exceptions.
