Pentedrone

Pentedrone is listed by its chemical name, 2-(methylamino)-1-phenylpentan-1-one, in Schedule I under 21 C.F.R. § 1308.11(d)(63), with DEA controlled-substance code 1246, and has been permanently scheduled since March 1, 2017. The listing covers any quantity in a material, compound, mixture, or preparation, including applicable salts and optical, positional, and geometric isomers, unless specifically excepted or listed in another schedule. Under federal law, knowing or intentional possession is prohibited unless validly prescribed, ordered, or otherwise authorized; unauthorized manufacture, distribution, dispensing, and possession with intent to perform those activities are also prohibited.

Pentedrone is listed by exact name as PENTEDRONA or 2-(METILAMINO)-1-FENIL-PENTAN-1-ONA in Lista F2 of Portaria SVS/MS nº 344, de 12 de maio de 1998, and has been included there since 20 February 2015; authorized bodies and institutions may conduct strictly medical and scientific research involving proscribed substances. Under Article 28 of Lei nº 11.343/2006, unauthorized acquisition, keeping, storage, transport, or carrying for personal consumption is subject to a warning, community service, or attendance at an educational program or course. Article 33 caput separately prescribes five to fifteen years' imprisonment and 500 to 1,500 day-fines for its listed unauthorized conduct, including production, manufacture, acquisition, sale, offering, storage, transport, import, export, and supply. Article 33 §3 instead prescribes six months to one year of detention and 700 to 1,500 day-fines, without prejudice to Article 28 measures, for occasionally offering a drug without profit to a person in one's social circle for joint consumption; §4 permits a one-sixth-to-two-thirds sentence reduction for qualifying caput and §1 offences when the offender is a first offender with a good record, does not engage in criminal activities, and does not belong to a criminal organization.

Pentedrone is listed by its exact name, 1-Phenyl-2-methylaminopentan-1-one, and CAS number 879722-57-3 as item 87 in the 2025 Catalogue of Non-Medical Narcotic Drugs and Psychotropic Substances. The current catalogue took effect on 21 July 2025 and retained Pentedrone's designation from the 2015 supplementary catalogue, which took effect on 1 October 2015. Production, business operation, use, storage, and transport are prohibited, while approved experimental research is permitted.

Pentedrone is listed by exact name as Pentedron and as 1-fenyl-2-(methylamino)pentan-1-on in Annex No. 4, List No. 4 of psychotropic substances, of Government Regulation No. 463/2013 Coll. Substances and preparations containing List No. 4 psychotropic substances may be used only for limited research and scientific purposes and very limited therapeutic purposes specified in a handling permit. Section 4 of Act No. 167/1998 Coll. requires a permit to handle addictive substances and preparations unless the Act provides otherwise. Government Regulation No. 243/2015 Coll. replaced Annex No. 4 with the table containing pentedrone, effective 1 October 2015.

Pentedrone is listed under the name Pentedron, chemically 2-(Methylamino)-1-phenylpentan-1-on, in Anlage II of the Betäubungsmittelgesetz, which covers marketable but non-prescribable narcotic drugs. As a general rule, and subject to the statutory exceptions in § 4, § 3 requires authorization from the Federal Institute for Drugs and Medical Devices to cultivate, produce, trade in, import, export, supply, sell, otherwise place on the market, or acquire narcotic drugs. Under § 29(1), unauthorized cultivation, production, trade, import, export, sale, supply, otherwise placing on the market, acquisition, or otherwise procurement, as well as possession without written authorization for acquisition, is punishable by imprisonment for up to five years or a fine. A court may refrain from punishment in a personal-use case involving a small quantity under § 29(5) BtMG.

Pentedrone is listed by exact name as Pentedron, 2-(Methylamino)-1-phenylpentan-1-on, in Annex 5, Verzeichnis d, of the Betäubungsmittelverzeichnisverordnung (BetmVV-EDI). Verzeichnis d comprises prohibited controlled substances. Pentedrone generally may not be cultivated, imported, manufactured, or placed on the market, although the Federal Office of Public Health may authorize dealings for specified purposes. The listing took effect on 1 October 2017.

Pentedrone falls within the generic structural definition in paragraph 1(aa) of Part II of Schedule 2 to the Misuse of Drugs Act 1971 and is therefore controlled as a Class B drug. Its structure is derived from 2-amino-1-phenyl-1-propanone by alkyl substitution at the 3-position and at the nitrogen atom under paragraph 1(aa)(ii) and (iii); it is not among the excluded compounds. The applicable generic definition has been in force since 16 April 2010. Possession, production, supply, import, and export are prohibited, subject to the licences, regulations, exceptions, and defences provided by the Act and subordinate legislation.
