4-HO-DET

4-HO-DET (4-hydroxy-N,N-diethyltryptamine) is not separately listed in the current federal controlled-substance schedules; DEA has expressly identified it among differently substituted tryptamines that are not directly controlled in Schedule I but may be treated as Schedule I controlled substance analogues when intended for human consumption under the federal analogue provisions, effective since October 27, 1986. Such treatment is case-specific: the substance must have a chemical structure substantially similar to that of a Schedule I or II controlled substance and must either have a substantially similar or greater stimulant, depressant, or hallucinogenic effect on the central nervous system, or be represented or intended to have such an effect; the statutory exclusions must not apply. Under 21 U.S.C. § 813, a qualifying analogue is treated as a Schedule I controlled substance only to the extent it is intended for human consumption; subject to federal authorizations and applicable knowledge and intent requirements, §§ 841(a)(1) and 844(a) then prohibit possession, manufacture, distribution, dispensing, and possession with intent to manufacture, distribute, or dispense it. This classification concerns United States federal law only and does not determine the law of any state, territory, tribal jurisdiction, or locality.

4-HO-DET is listed as Psilocin-(eth) in Anlage I of the Betäubungsmittelgesetz, which classifies it as a non-marketable narcotic drug. Under § 29(1), unauthorized manufacture, trade, import, export, supply, sale, placing on the market, acquisition, procurement, and possession are punishable by imprisonment for up to five years or a fine. A court may refrain from punishment when the drug was solely for personal consumption in a small quantity. Authorization may be granted only exceptionally for scientific or other public-interest purposes.

The annex to Förordning (1999:58) om förbud mot vissa hälsofarliga varor expressly lists 4-hydroxi-N,N-dietyltryptamin (4-HO-DET) as a good deemed hazardous to health under Lag (1999:42) om förbud mot vissa hälsofarliga varor. Import, transfer, production, acquisition for transfer, commercial handling, offering for sale, and possession are prohibited without a permit; permits may be granted for scientific or industrial handling. The listing took effect on 1 November 2005.

4-HO-DET is expressly listed as item 125 in Annex 6, Verzeichnis e, of the Betäubungsmittelverzeichnisverordnung. Materials and products in Verzeichnis e are subject to the control measures applicable to Verzeichnis a narcotics. Cultivation, manufacture, import, export, storage, use, or placing on the market requires authorization from the Federal Department of Home Affairs; unauthorized conduct is punishable by up to three years' imprisonment or a monetary penalty.

4-HO-DET is a Class A drug under Schedule 2 Part I paragraph 1(b)(i) of the Misuse of Drugs Act 1971 because its ring-hydroxy tryptamine structure bears two alkyl substituents on the side-chain nitrogen. The current paragraph 1(b) took effect on 7 January 2015. The Act prohibits possession, possession with intent to supply, production, supply, and offering to supply, subject to applicable regulations, licences, and statutory defences.

4-HO-DET is expressly listed as 3-[2-(diethylamino)ethyl]-1H-indol-4-ol in the annex to Valtioneuvoston asetus 1130/2014 as a psychoactive substance banned from the consumer market. Under Huumausainelaki 373/2008, manufacture, import into Finland, storage, offering for sale, and supply are prohibited. Statutory exceptions apply to qualifying research and industrial activities. The original decree entered into force on 20 December 2014, and the current replacement annex under Decree 650/2026 retains the listing.
