3F-PCP is prohibited in Hungary and is listed by exact name and as 1-[1-(3-fluorophenyl)cyclohexyl]piperidine in Annex 3, point 6.1, row 250 of 78/2022. (XII. 28.) BM rendelet. The schedule classifies it as an Új pszichoaktív anyag, and it has been listed by exact name since 11 June 2021. For the Criminal Code, Annex 3 substances are treated as kábítószer: unauthorized production, acquisition, possession, import, export, transit, offering, transfer, distribution, and trade are criminalized. This does not prohibit every authorized activity. Under 66/2012. (IV. 2.) Korm. rendelet, appropriately licensed entities may conduct research, and new psychoactive substances may be licensed for limited industrial purposes involving material unfit for human consumption; that industrial authorization does not extend to developing or producing a product capable of introducing the substance into the human body. Separately, Criminal Code section 180 provides conditional non-punishment—not general legality—for a person who cultivates, produces, acquires, possesses, or orders a small quantity for personal use, or consumes a drug, if the person admits the offense, documents at least six continuous months of the specified treatment, care, or preventive-education service before the first-instance decision, and, before indictment, either discloses the circumstances of the offense or enables identification of the seller. The rule is unavailable if, within the preceding two years, proceedings were suspended on this ground or criminal responsibility was established for drug trafficking or possession, and it is also unavailable after the treatment-based opportunity has already been used twice.
