Yerba-Mate

Yerba mate, maté, Ilex paraguariensis, and caffeine are not listed in Schedule 2 to the Misuse of Drugs Act 1971, and the schedule's botanical provisions do not otherwise cover Ilex paraguariensis. The current temporary class drug order is confined to seven named synthetic opioids and does not cover yerba mate, Ilex paraguariensis, or caffeine. The Food Standards Agency classifies material from Ilex paraguariensis leaves and herbs as mate infusion material, while Schedule 1 to the Psychoactive Substances Act 2016 exempts substances ordinarily consumed as food, including drink, subject to its conditions for naturally occurring psychoactive ingredients. This exemption supports ordinary, unadulterated yerba-mate leaf and infusion; concentrated extracts, adulterated products, medicinal presentations, and other formulations remain subject to the food, novel-food, medicines, labelling, import, and territory-specific rules applicable to the particular product.
