MiPT

The DEA identifies MiPT as a positional isomer of diethyltryptamine, which is listed in Schedule I(c)(5) of the Controlled Substances Act. Under federal law, knowingly or intentionally possessing, manufacturing, distributing, or dispensing MiPT, or possessing it with intent to manufacture, distribute, or dispense it, is unlawful unless authorized. State, territorial, and local laws may impose separate requirements.

MiPT is covered by the generic structural definition for the indole-3-alkylamine group numbered 5.1 in Annex 1 to the Neue-psychoaktive-Stoffe-Gesetz (NpSG), in force for this substance group since 18 July 2019, rather than being listed by name. Its N-methyl-N-isopropyltryptamine structure and molecular mass of 216.1621 Da meet the definition's limits of C1 to C6 alkyl substituents on the terminal amine and a molecular mass not exceeding 500 u. The NpSG prohibits trade, placing on the market, manufacture, import, export, transit, acquisition, possession, and administration to another person, subject to exclusions for substances governed as narcotic drugs, medicines, veterinary medicines, or covered medical devices and exceptions for recognized commercial, industrial, scientific, and specified official uses. Under § 4(1), trade, placing on the market, administration to another person, and manufacture or movement into Germany for the purpose of placing the substance on the market are punishable by up to three years' imprisonment or a fine; simple acquisition and possession are prohibited but are not included among those ordinary offences.

N-isopropyl-N-methyltryptamine (MiPT) and its salts are listed as designated substances under Article 1, item 54 of Ministry of Health, Labour and Welfare Ordinance No. 14 of 2007. Article 76-4 of the governing Act prohibits their manufacture, import, sale, transfer, possession, purchase, receipt, and use for purposes other than qualifying medical or other permitted uses. The ordinance entered into force on 1 April 2007.

MIPT is expressly listed by chemical name under hallucinogens in Annex 1 to Förordning (1992:1554) om kontroll av narkotika and in Förteckning I of the Medical Products Agency's narcotics lists. The classification has been in force since 2 July 2019, and Förteckning I covers substances that normally have no medical use. Unauthorized possession, use, production, sale, transfer, acquisition for transfer, transport, storage, import, and export are prohibited, subject to authorized medical, scientific, specially important public-interest, and specified industrial channels. Under 1 § Narkotikastrafflag (1968:64), unauthorized transfer, production for abuse, acquisition for transfer, specified handling, possession, or use is punishable by up to three years' imprisonment; sale-related conduct carries six months to three years, with separate provisions for minor, gross, and exceptionally gross offenses.

MiPT is covered by the generic tryptamine entry in Annex 6, Verzeichnis e, number 266, of the Betäubungsmittelverzeichnisverordnung because its side-chain nitrogen bears methyl and isopropyl alkyl substituents. The entry excludes substances already controlled in Verzeichnisse a, b, d, or f and exempts industrial and scientific use, but private use is not exempt. Under Article 7 of the Betäubungsmittelgesetz, cultivation, manufacture, import, export, storage, use, or placing on the market requires authorization from the Federal Department of Home Affairs and compliance with its conditions.

MiPT falls within the generic tryptamine definition in Schedule 2 Part I paragraph 1(b)(i) of the Misuse of Drugs Act 1971 and is therefore a Class A drug. The definition has covered its N-methyl-N-isopropyl structure since 20 September 1977; MiPT is not separately named in the schedule. The Act prohibits possession, possession with intent to supply, production, supply, offering to supply, import and export. These restrictions are subject to applicable regulations, licences and statutory defences.
