Fenethylline

Fenethylline is listed by name as a Schedule I stimulant in 21 C.F.R. § 1308.11(f)(7), under DEA Controlled Substances Code Number 1503. The federal classification has applied since 20 August 1981 and covers any quantity of fenethylline, including its salts, isomers, and salts of isomers, unless specifically excepted or listed in another schedule. Under federal law, unauthorized possession, manufacture, distribution, dispensing, and possession with intent to manufacture, distribute, or dispense are unlawful.

Fenethylline, spelled FENETYLLINE in the instrument, is listed in Schedule 9 of the Therapeutic Goods (Poisons Standard—June 2026) Instrument 2026. Schedule 9 covers prohibited substances whose manufacture, possession, supply, or use should be prohibited except for approved medical or scientific research or analytical, teaching, or training purposes. Poisons Standard classifications are recommendations implemented through State and Territory legislation, so specific offences and exceptions depend on the applicable jurisdiction. Fenethylline is also listed as a drug in Schedule 4, item 92, of the Customs (Prohibited Imports) Regulations 1956; its importation generally requires both a licence and permission, subject to the Regulations' specified exceptions.

Fenethylline, spelled Fenetylline in the Act, and its salts are expressly listed in Schedule III, item 20, of the Controlled Drugs and Substances Act. Unauthorized possession, trafficking, possession for trafficking, import, export, and production are prohibited. The Controlled Substances Regulations also list Fenetylline and its salts in Schedule 2, item 6, but that schedule is not yet in force; the Regulations come into force on October 1, 2026.

Fenethylline is listed by name as a Class C drug in Schedule 2 Part III of the Misuse of Drugs Act 1971 and in Schedule 2 of the Misuse of Drugs Regulations 2001. It has been included in Class C since 1 April 1987. Subject to applicable regulations, licences, exceptions and statutory defences, possession, possession with intent to supply, production, supply, offering to supply, import and export are prohibited.

Fenethylline is listed by its exact Portuguese name, Fenetilina, as item 8 of Lista A3 in Portaria SVS/MS nº 344, de 12 de maio de 1998, Anexo I, as updated by Resolução da Diretoria Colegiada Anvisa nº 1.036, de 9 de julho de 2026. Lista A3 covers psychotropic substances subject to Notificação de Receita A. Under article 35 of Portaria SVS/MS nº 344, a prescription notification accompanied by a prescription authorizes the dispensing of medicines based on Lista A3 substances, and a pharmacy or drugstore may dispense them only when the prescription and notification are fully completed. The Lista A3 addendum also covers salts, ethers, esters, and isomers of listed substances when their existence is possible, subject to the stated exceptions.

Fenethylline is listed by exact name in Anlage III of the Betäubungsmittelgesetz as a marketable and prescribable narcotic drug. Under § 13, physicians, dentists, and veterinarians may prescribe it only when its administration is justified, and dispensing generally occurs through a pharmacy against the prescription. The unauthorized dealings enumerated in § 29(1), and possession without written authorization to acquire the drug, are punishable by imprisonment for up to five years or a fine. Under § 29(5), a court may refrain from punishment when the drug was handled or possessed only for personal use in a small quantity.
