Cake

Ordinary sugary cake, not a psychoactive substance, was the subject of a 2017 April Fools' satire. Molossia's official Tiki Hut menu offers a slice of chocolate Lava Cake with chocolate chips, marshmallow and sauce for VL 2.00. Molossia is an unrecognized micronation on private property in Dayton, Nevada, so food offered for sale at that location is subject to Nevada law. Nevada Revised Statutes Chapter 580 defines food to include a confection intended for human consumption and offered for sale. It generally requires a food-establishment permit following inspection and prohibits operating a food establishment without a valid permit. A qualifying cottage food operation is exempt from food-establishment status but must satisfy requirements including registration, direct in-person sales, labeling and protective packaging. The cottage-food baked-goods category excludes potentially hazardous goods, goods containing cream, uncooked egg, custard, meringue or cream-cheese frosting or garnishes, and goods requiring time or temperature controls. The menu does not provide enough information to determine whether the Lava Cake is sold under a food-establishment permit or qualifies for the cottage-food exemption. Chapter 580 regulates the commercial preparation, offering, sale and service of food; it does not prohibit merely purchasing or possessing ordinary cake.
