4-HO-DPT

4-HO-DPT is not separately named in the current federal controlled-substance schedules. A 2006 DEA notice expressly identifies 4-hydroxy-N,N-dipropyltryptamine among differently substituted tryptamines that were not subject to direct Schedule I control, while explaining that some such substances can nevertheless be treated as Schedule I controlled-substance analogues when intended for human consumption. The Controlled Substance Analogue Enforcement Act of 1986, effective 27 October 1986, enacted the analogue definition now codified at 21 U.S.C. § 802(32) and the treatment rule now codified at § 813. That treatment is conditional: 4-HO-DPT must satisfy the statutory definition and exclusions, and § 813 applies only to the extent it is intended for human consumption. Sections 841 and 844 are separate Controlled Substances Act offense provisions that apply after § 813 treats a qualifying analogue as a Schedule I controlled substance; they were not enacted as analogue provisions. This classification concerns federal law and does not establish the law of any state, the District of Columbia, territory, tribal jurisdiction, or locality.

4-HO-DPT falls within the generic structural definition of indol-3-alkylamines in Anlage 1 Nr. 5.1 of the Neue-psychoaktive-Stoffe-Gesetz (NpSG), rather than being listed by name. This coverage has applied since 18 July 2019. NpSG § 3(1)(1) prohibits trade, placing on the market, manufacture, import, export, transit, acquisition, possession, and administration to another person, subject to the exclusions in § 1(2) and the recognized commercial, industrial, scientific, and official-use exemptions in § 3(2). Under § 4(1), trade, placing on the market, or administration to another person, and manufacture or import for the purpose of placing the substance on the market, are punishable by up to three years' imprisonment or a fine; mere acquisition and possession are not enumerated there as standalone offenses.

4-HO-DPT is expressly listed as 4-hydroxi-N,N-dipropyltryptamin (4-HO-DPT) in the annex to Förordning (1999:58) as a good deemed hazardous to health under Lag (1999:42). Without a permit, its import, transfer, production, acquisition for transfer, commercial handling, offering for sale, and possession are prohibited; permits may be granted for scientific or industrial handling. The substance was added to the annex by SFS 2018:116, effective 10 April 2018. It is not listed as a narcotic in the current consolidated narcotics list through HSLF-FS 2026:26, which names the distinct unsubstituted substance N,N-dipropyltryptamin (DPT).

4-HO-DPT is expressly listed as item 292 of Annex 6, Verzeichnis e, of the Betäubungsmittelverzeichnisverordnung (BetmVV-EDI). The listing entered into force on 31 March 2023 at 10:00. Federal Department of Home Affairs authorization is required for cultivation, manufacture, import, export, storage, use, or placing on the market; unauthorized conduct is punishable by up to three years' imprisonment or a monetary penalty.

4-HO-DPT is controlled as a Class A drug under the generic structural definition in Schedule 2 Part I paragraph 1(b) of the Misuse of Drugs Act 1971. The current definition took effect on 7 January 2015 and covers ring-hydroxy tryptamines whose side-chain nitrogen bears two alkyl substituents, encompassing 4-HO-DPT's two propyl groups. Possession, possession with intent to supply, production, supply, offering to supply, import, and export are restricted, subject to applicable regulations, licences, and statutory defences.
